Introduction
For me, there are similarities between mountain expeditions, piloting, and fighting Covid, especially when it comes to taking risks and overturning all plans at crucial moments for the sake of the group/passengers or nations (in the case of Covid). When climbing a mountain in a group, you try to conquer the highest mountains but also limit losses, while as a pilot you focus on reaching the destination and keeping everyone safe. Fighting the pandemic is no different; we want to defeat it and also limit losses. What can companies learn from this? In mitigating risks, differences need to be highlighted because emphasizing cooperation and group decision-making can undermine the fact that one opinion deserves precedence over others. In this case, the group’s most expert member is responsible for success, whether in mountain expeditions, piloting, fighting Covid, or running a business.

2. Rückblick auf die Structured Finance 24. / 25.Nov 2021
Die SF 2021 am 24. und 24. November fand als Hybrid-Veranstaltung statt. Nichtreisende hatten so die Möglichkeit, fast alle Inhalte der Veranstaltung mitzuerleben. Leider ergaben sich mit täglich steigenden höheren Covid - Ansteckungen und dem teilweisen Lockdown in Österreich wahrscheinlich erneut Abmeldungen. Teilnehmer, die sich für den Aufenthalt in Stuttgart entschieden, konnten von vielen Vorträgen und dem gemeinsamen Dinner am 24.11. profitieren.

3. New Tax Rules for Financial Institutions in Zurich
The Zurich Cantonal Tax Authority (ZCTA) has issued a new circular on the taxation of financial institutions, which enters into force retrospectively as of 1 January 2021 (for financial years ending in 2021). The circular applies to banks and professional securities dealers.
Charles Hermann, Partner Financial Services Tax, KPMG, presents the key amendments:
- The tax deductions for value adjustments for default risks of debtors will depend on the regulatory status of the bank;
- The rates for lump sum provisions are lower than in the previous circular (2015);
- A lower participation deduction relief is applicable on dividends generated by shares held for trading purposes.
Furthermore, Hermann explains that banks in FINMA category 1 and 2 can no longer claim any tax deduction for lump sum provisions for default risks of debtors. For banks in FINMA category 3, 4 and 5, the new rates for lump sum provisions are
- 3% for Swiss debtors;
- 5% for foreign debtors;
- 10% for any other unsecured claims.
These banks cannot constitute any lump sum provisions for default risks of debtors that are banks and governmental entities. Where the maximum of the acceptable lump-sum provisions is not reached, a new allocation to reserves for general banking risks can be deductible for tax purposes.
The taxation of financial institutions varies from canton to canton, but there is a clear intention for harmonization. As Hermann explains, we cannot exclude the possibility that the new practice will become the new standard approach for the taxation of financial institutions in all cantons.
Adjustments required due to the circular must be made at the latest by 2027 on a linear basis.

4. Eigenwechsel neu als eNotes
Ein Eigenwechsel (Commercal Paper) ist ein bedingungsloses Versprechen, einen bestimmten Betrag an eine andere Partei zu einem bestimmten zukünftigen Zeitpunkt zu zahlen. Bisher war die Übertragung eines Schuldscheines eine komplizierte manuelle Angelegenheit.
Die eNote basiert auf der Blockchain-Technologie. Sie kann flexibel an jede beliebige dritte Partei (d. h. einen Anleger) verkauft und übertragen werden. Im Vergleich zu anderen Finanzierungsoptionen zeichnen sich eNotes als handelbare Instrumente durch ihre finanzielle Steuerungsfähigkeit und globale Übertragbarkeit aus. eNotes basieren auf den weltweit bewährten, ehemals papierbasierten "Schuldscheinen".

An eNote is a promise to pay an amount to a third party at a specific future date, based on Blockchain technology; it can be sold and transferred to any third party.

The eNote infrastructure can be integrated into financing platforms of banks and fintechs and can have the potential to facilitate trade finance and money markets. 5. Inflation in the US and EU
US
The increase in US consumer prices is nearly 7% and 11% when house prices are added. According to an article in Fortune magazine, price increases will continue, and U.S. authorities finally admitted this week that inflation cannot be called short-term anymore. Both Fed Chairman Jerome Powell and Treasury Secretary Janet Yellen said that it’s time to retire the term “transitory” when discussing the current U.S. inflation trends. Details on Fortune.com
Europe
Similar in Europe, consumer prices rose an annual 4.9% in November, topping all 40 predictions in a Bloomberg survey of economists, where the median was for 4.5%. A measure that strips out volatile components such as food and energy also reached a record. The euro and bond markets were little changed after the publication of the data.

6. No Business-WhatsApp-Messages after EOD in Portugal
Portugal becomes the first nation in Europe to pass a home office law, which states that employees cannot be stressed outside office hours by superiors. Violations of the “right to rest” face heavy fines. Is this law going to become a Europe-wide model?
The new ban protects all employees in Portugal, regardless of whether they work at home or in the office. Exceptions only apply in "unforeseeable events in the company" about which the employees should be informed.
Moreover, the home office decree grants all office workers with children up to eight years of age the opportunity to work from home. The employer may not refuse to do so if teleworking is possible. The right to work from home only applies if the company has at least ten employees.
Companies with more than 10 staff could face fines if they contact employees outside their contracted hours.

7. The Best Inventions of 2021
Each year, TIME compiles a list of 100 inventions that are making the world better and more innovative. To assemble this year’s list, they solicited nominations across a variety of categories from TIME’s editors and correspondents around the world, then evaluated each contender on a number of factors, including originality, creativity, efficacy, ambition, and impact.
This year’s list includes, among others, vaccines for COVID-19 and malaria, an emotional support robot for hospitalized children, an environmentally friendly dye for jeans and a brand-new pasta shape.
8. Book Tip – Wuhan: Dokumentar-Roman (German Edition)
This book tells the story of Chinese journalists who traveled to Wuhan to investigate the outbreak of the coronavirus. Right after the outbreak, the author, Liao Yiwu, downloaded and gathered a lot of content that in the meantime has been censored or deleted. Data were analyzed to conclude whether the virus was man-made or a bioweapon.

In diesem Buch erzählt Liao Yiwu die Geschichte der chinesischen Journalisten, die es wagten, nach Wuhan zu reisen, um den Ausbruch des Corona Virus zu untersuchen. Liao Yiwu gelang es, unmittelbar nach dem Ausbruch des Virus eine Vielzahl von Informationen zu sammeln und eine enorme Menge an Inhalten herunterzuladen. In der Zwischenzeit wurden viele dieser Informationen zensiert oder gelöscht.
Nach der Analyse aller Daten kommt Liao Yiwu zu dem Schluss, dass es sich bei dem Virus weder um eine vom Menschen verursachte, noch um eine Biowaffe handelt. Für Liao Yiwu deutet alles darauf hin, dass es sich einfach um einen Unfall handelt. Offizielle chinesische Quellen bestätigten die Existenz des Virus, doch später vertuschte die Regierung alles. Dann verbreitete sich das Virus in Wuhan und in der ganzen Welt.
Dieses Buch wurde von Verlagen in Japan, Deutschland und Italien angenommen. In Frankreich und den USA laufen Verhandlungen über eine baldige Veröffentlichung.

In der DDR aufgewachsen, begann ihr politischer Weg innert der Wiedervereinigung Deutschlands. Oft musste sie sich in reinen Männerrunden behaupten.
