EMIR Entwurf der EU-Kommission: Zurück auf Feld eins?

Sabine Paulus von VDT: Die EU-Kommission veröffentlicht im Dezember 2022 einen Entwurf zur Änderung der Europäischen Marktinfrastrukturverordnung (EMIR). Er bringt Änderungen im Zusammenhang mit CCPs (Central Counterparty Clearing Houses) und unterstreicht die Aufhebung der Erleichterung bei der Meldung von gruppeninternen OTC-Derivaten. Unternehmen, die Erleichterungen nutzen, müssten eine Meldeinfrastruktur für konzerninterne Transaktionen aufbauen.

Der Entwurf der EU-Kommission fordert die ESMA auf, die bestehenden Regeln zur “Hedging-Ausnahme” zu überarbeiten, was sich auf die Bemessungsgrundlage für die Clearingschwelle auswirken und möglicherweise zu einer Überschreitung der Schwelle führen kann.

Die Marktteilnehmer können bis März 2023 zu den Änderungsvorschlägen Stellung nehmen. Der Verband Deutscher Treasurer wird seinen Beitrag über seine Arbeitsgruppe EMIR Refit aus dem Bereich Risikomanagement einbringen.

In December 2022, the EU Commission published a draft amendment to EMIR that includes changes related to context of CCPs and emphasizes the withdrawal of the facilitation for reporting intra-group OTC derivatives. This means that companies would have to rebuild a reporting infrastructure for intra-group transactions in order to be able to report all intra-group transactions again. Moreover, the draft calls on ESMA to revise the existing rules on “hedging exception”, which may impact the assessment basis for the clearing threshold and potentially exceed the threshold.

Nothing has been decided yet; market participants can still comment on the proposed amendments until March 2023.
